QBPC Presents Top Ten Case Appreciation Plaque to Beijing Intellectual Property Court

On the afternoon of August 15, Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment (QBPC) Chair Michael Ding, Best Practices/Enforcement Committee Vice Chair Zhang Hongkai and representative of Medtronic, INC. Jeff Li, presented the QBPC 2021-2022 Annual Top Ten Cases Appreciation Plaque to Beijing Intellectual Property Court (BJIPC).

 

First of all, Michael Ding briefly introduced the organizational structure, work focus and the Annual Top Ten Cases Selection of QBPC. The Selection were divided into three categories of IPR: criminal and criminal procedures, civil and civil procedures, and administrative and administrative procedures. A total of 74 cases nominated by QBPC members participated in the evaluation this year, which provided members with an opportunity to share the highlights of the cases and learn from each other. In the end, 31 cases stood out, including the " Trademark  Administrative  Litigation Regarding  Medtronic’s  Invalidation  against Malicious  Registration  of ‘MEYDUNLG 美敦力加’ trademark  filed  by  Suzhou Puluoxin Investment Consulting Co., Ltd., handled by Judge Zhou Liting of BJIPC. Therefore, QBPC and representative of Medtronic, INC. expressed their gratitude to BJIPC for its efforts in safeguarding the legitimate rights and interests of consumers and enterprises as well as improving the business environment of China.

 

Judge Zhou Liting expressed her gratitude to QBPC for its recognition of the trial by BJIPC. In recent years, IPR protection had developed rapidly with new situations and practices emerged in many fields. She expected QBPC to continue with its role as a bridge to jointly promote the development of IPR protection.


Jeff Li, representative of Medtronic, INC., said that a fair and effective judicial system would certainly enhance the confidence of foreign-funded enterprises in investing and developing in China. He thanked the BJIPC for enforcing the law impartially. It was believed that similar typical cases would have strong deterrence on potential violators while serving as a good model for the whole society. A good business environment would encourage the Medtronic's headquarter to introduce more cutting-edge medical device products into the local market, thereby benefiting more Chinese patients.


Zhang Hongkai mentioned that as a platform, QBPC encouraged members to extensively share best practices, which was beneficial in promoting the mutual learning among members and achieving social effects spreading from one point to the whole area. The Annual Top Ten Cases Selection was only the beginning. After the selection, the communication with relevant enforcement agencies was crucial, which was conducive to the promotion of typical cases.Finally, QBPC delegation presented Top Ten Cases Appreciation Plaque to BJIPC and looked forward to more professional cooperation between the two sides in the future.
