Visit to General Enforcement Corps of BJMAMR

On the morning of August 15, Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment (QBPC) Chair Michael Ding and representatives of Universal City Studios LLC visited the General Enforcement Corps of Beijing Municipal Administration for Market Regulation (BJMAMR), and presented the QBPC 2021-2022 Annual Top Ten Cases Appreciation Plaque. He Jie, Deputy Chief Commander and Supervisor, Li Song, Captain of the Eighth Detachment, Liu Shuwei, Deputy Captain of the Eighth Detachment, and Hu Shike, the fourth level senior clerk of the Eighth Detachment, warmly received the delegation of QBPC.

 

First of all, QBPC Chair Michael Ding briefly introduced the organizational structure, work focus and the Annual Top Ten Cases Selection of QBPC. The Selection were divided into three categories of IPR: criminal and criminal procedures, civil and civil procedures, and administrative and administrative procedures. A total of 74 cases nominated by QBPC members participated in the evaluation this year, which was the most competitive in history. In the end, 31 cases stood out, including the "Unfair Competition Enforcement against City Light Real Estate Project using the unique name of Universal Studio, handled by the General Corps. Therefore QBPC and the representatives of the right holder of Universal City Studios LLC, the nominator of this case, expressed their gratitude to the General Corps for its efforts in safeguarding the legitimate rights and interests of consumers and enterprises and improving the business environment of China.

 

According to the representatives of Universal City Studios LLC, the administrative law enforcement had the characteristics of high efficiency and quick results, which was very applicable to the above-mentioned case. In addition, the enforcement team in Beijing was rigorous and meticulous in applying relevant laws. It was hoped that this case could be demonstrated and promoted on the platform of QBPC as a typical case, so as to effectively deter potential illegal and criminal acts.

 

Captain Li Song mentioned that after the establishment of the Eighth Detachment, he had been looking forward to communicating with relevant industry associations on IPR. Therefore, he appreciated the visit of QBPC. He gave a detailed introduction of the law enforcement work such as the database of IP owners, the Beijing-Tianjin-Hebei coordination system and online transactions. Li expected to establish a cooperation mechanism with QBPC for regular exchanges, identifying right holders with the need for enforcement, so as to quickly connect with the right holders and improve law enforcement efficiency. In terms of online transactions, the Eighth Detachment was committed to the supervision over video platform compliance to protect market participants and consumers. In terms of the cooperation between Beijing, Tianjin and Hebei, the Detachment horizontally connected with Tianjin and Hebei, and vertically connected with various districts. On this basis, it conducted IP law enforcement training and shared the database of right holders. The Detachment paid more attention to the online live broadcast and short video platforms, and Li promised to help collect evidence when right holders found it difficult.

 

In his summary, He Jie pointed out that the selection of the case reflected the continuous improvement of the work of the Corps. Meanwhile it was also an incentive and promotion for the future law enforcement work. The Corps had always attached great importance to the protection of IPR, and had given equal protection to the IPR of foreign-invested enterprises in China. At the same time, he also looked forward to continuing in-depth cooperation with QBPC to jointly maintain the market order in terms of IP.

 

Finally, the delegation of QBPC presented Top Ten Cases Appreciation Plaque to the General Corps of BJMAMR and looked forward to more exchanges and closer cooperation between the two sides in the future.
