    Establishing a Smooth Communication Mechanism—QBPC Representative Attended and Addressed the China - US Seminar on Bad Faith Filings

    On August 21, 2017, the China – US Seminar on Bad Faith Filings was jointly hosted in Beijing by the Trademark Office of the State Administration for Industry & Commerce (SAIC) of the People's Republic of China and the United States Patent and Trademark Office (USPTO). The seminar was attended by representatives from the SAIC Trademark Office, USPTO, U.S. Embassy in China, QBPC, China Trademark Association, International Trademark Association, U.S. Chamber of Commerce, and some well-known brand enterprises at home and abroad.

    At the seminar, seven topics were covered. The development and challenge of bad-faith filings, and solutions thereto were discussed, and experience for combating bad-faith filings was shared.
    At the seminar, Vice Chairperson of the QBPC Legal Committee, Sophie Fu, delivered a keynote speech on the fourth topic—Panel on Recent Company Experiences Fighting Bad Faith Filings, put forward main types of bad-faith filings and challenges that enterprises face, and suggested solutions. Sophie Fu said that QBPC would like to establish a communication mechanism for the trademark examination together with the Trademark Office and the China Trademark Review and Adjudication Board and that QBPC would provide relevant member’s information (for example, a brand manual) to help improve the examination efficiency. Sam Zhou, Brand Protection Leader of Procter & Gamble (P&G)—a QBPC’s member company, greatly agreed about Sophie Fu's suggestion of establishing a communication mechanism. Sam Zhou made a speech on the sixth topic—Panel Discussion on How Can We Further Combat Bad-faith During the Examination Phase. Mr. Zhou shared cases related to P&G's well-known brands such as Head & Shoulders, Tide, and Gillette, introduced challenges that P&G has always been facing on brand protection from a practical perspective, and called on staff of the SAIC and Trademark Office as well as judges to attach much importance to intellectual property protection.

    The seminar positively promoted the China-US strategic cooperation on trademarks and brands. Participants said that they achieved a lot from the seminar and looked forward to the next meeting.
