    Dear All Members,

The State Intellectual Property Office (the "SIPO") newly released the draft 4th Amendments to the Patent Law of People's Republic of China (the "Patent Law") for public comments. The current Patent Law in effect was amended in 2008 and took effect on October 1, 2009. Since the Patent Law was promulgated in 1985, the Patent Law had gone through amendments for three times. Now it is under the 4th amendment. Please refer to the attached Chinese and English Comparison Table between the Current Patent Law and the draft 4th Amendments to the Patent Law for public comments for more information about the Articles to be amended. The Brief Description in Chinese concerning the background of the 4th Amendments to the Patent Law for public comments is also attached for your reference.

Your comments and inputs in due course on the draft 4th Amendments to the Patent Law for public comments are welcome and will be highly appreciated. Interested members, please send your comments and inputs in Chinese and English to Mr. Rehgar Wu at rehgarwu@qbpc.org.cn by COB September 3, 2012. Based on members’ comments, the Patent and Innovation Committee will draft QBPC position paper and submit it to SIPO in the name of QBPC. Though we will only submit the QBPC position paper in Chinese, it is appreciated if you can send us your comments in both Chinese and English.
