The Supreme People's Court (“SPC”) sought public opinions on the draft judicial interpretation concerning IP infringements on E-Commerce platforms in June. There were widespread concerns among QBPC members about counterfeits and copyright infringements occurring on the E-Commerce platforms. The draft opinion had already been discussed by representatives of member companies of Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment (“QBPC”) before. And this time, members of Luxury Goods IWG and Sports, Fashion & Life Style IWG delved deeper into the nitty gritty details of the draft and highly appreciated the positive direction the SPC took on the protection of intellectual property rights online.

The above-mentioned two IWGs held an online meeting on July 14th, and17 representatives attended the meeting. Miller Wang, the coordinator of Luxury Goods IWG hosted the meeting. He first introduced the theme and background of the meeting to the participants, and then organized an article-by-article discussion among the members. Summer Lee (A&F), Jack Zheng (Levi’s), Lisa Wang (Spalding) and Jason Yao (Lacoste authorized) discussed actively, summarized highlights and what need to be revised in the draft. Representatives of member companies expressed their unique views on the draft from the perspective of right holders and proposed comments. All these comments will be submitted to SPC by QBPC Office after meeting.

For many years, QBPC has been highly cooperating with SPC, actively organizing members to participate in the public-consultations, and put forward many constructive opinions, many of which were eventually adopted by the Supreme Court. QBPC will make consistent and continuous efforts to contribute to the protection of intellectual property rights and further improve the legal environment.
